1. Introduction

Welcome to Famous Title. These Terms and Conditions govern your use of our website builder service and constitute a legally binding agreement between you and Famous Title, LLC. By accessing or using Famous Title, you agree to be bound by these terms.

Please read these terms carefully before using our service. You must be at least 18 years old to use Famous Title. If you do not agree to these terms, you may not access or use our service.

2. Description of Service

Famous Title is a website builder platform that allows users to create, edit, and publish websites using our template-based editor. We provide hosting on famoustitle.com subdomains, custom domain support, AI-powered SEO optimization, website export and import, and related services to help you build and maintain your online presence.

Paid plan subscribers can create and manage multiple websites under a single account. Max plan subscribers gain access to additional features including an integrated e-commerce storefront for selling products, with payment processing provided through Stripe Connect.

3. User Accounts & Registration

To use Famous Title, you must create an account. When creating your account, you agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your password and account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. User Content & Intellectual Property

You retain ownership of all content you create using Famous Title, including text, images, and other materials you upload or create. By using our service, you grant Famous Title a non-exclusive, worldwide license to host, display, and distribute your content solely for the purpose of providing the service to you.

Famous Title templates, designs, software, and all related intellectual property remain the property of Famous Title, LLC. You may use our templates to create your websites but may not redistribute, sell, or sublicense them separately.

5. Acceptable Use Policy

You agree not to use Famous Title for any unlawful purpose or in any way that could harm our service or other users. Prohibited activities include:

• Creating websites that contain illegal, harmful, or offensive content
• Distributing malware, viruses, or other harmful code
• Sending spam or unsolicited communications
• Infringing on the intellectual property rights of others
• Attempting to gain unauthorized access to our systems or other users' accounts
• Engaging in any activity that disrupts or interferes with our service

6. Payment Terms

Famous Title offers both free and paid subscription plans. Paid subscriptions are billed on a monthly or annual basis, as selected at the time of purchase. Refund requests are evaluated on a case-by-case basis and are not guaranteed. We reserve the right to change our pricing with 30 days' notice to existing subscribers.

Certain features include usage limits per billing period. AI-powered SEO generation is available to Max plan subscribers and is limited to 50 generations per billing period. If you require additional generations, please contact us at support@famoustitle.com.

If your payment fails and your subscription enters a past-due state, the following enforcement actions will apply:

• After 7 days of non-payment: Your published websites will be placed into maintenance mode and will no longer be accessible to visitors.
• After 14 days of non-payment: Your websites will be deleted and your subdomains will be released. Released subdomains may be claimed by other users.

If you resolve your past-due payment, you may restore your deleted websites. If your original subdomain is still available, you may reclaim it. If it has been claimed by another user, you will need to select a new subdomain. We are not responsible for the loss of any subdomain during a period of non-payment.

Cancellation

You may cancel your paid subscription at any time from your account settings. Upon cancellation, you will retain full access to your paid features until the end of your current billing period. After the billing period ends, your account will revert to the Free plan, and any content or features exceeding Free plan limits will become inaccessible on your public website but will not be deleted.

No prorated refunds are issued for the remaining portion of a billing period after cancellation. You may resubscribe to a paid plan at any time to regain access to your content.

7. Storefront & Marketplace

Max plan subscribers may use the integrated storefront feature to list and sell products to buyers. By using the storefront, you agree to the following additional terms:

Seller Responsibilities

• You are solely responsible for the accuracy of your product listings, including descriptions, pricing, and images
• You are responsible for fulfilling orders in a timely manner, including shipping and delivery
• You must handle customer service, returns, and refunds for your products
• You are responsible for compliance with all applicable laws, including consumer protection and tax obligations

Platform Fees

Famous Title charges a platform fee of 3% plus $0.50 per transaction on all storefront sales. This fee is in addition to Stripe's standard payment processing fees (currently 2.9% + $0.30). Platform fees are deducted automatically from each transaction before funds are transferred to your Stripe Connect account.

Transaction Relationship

Famous Title acts as a platform facilitating transactions between sellers and buyers. We are not a party to the transaction between you and your customers. We do not take title to any products and are not responsible for the quality, safety, or legality of items sold through the storefront.

Stripe Connect

To receive payments, sellers must connect a Stripe account. By using the storefront, you also agree to Stripe's Connected Account Agreement. Famous Title reserves the right to suspend storefront access if your Stripe account is deactivated or flagged for violations.

8. Termination

We may suspend or terminate your account at any time if you violate these terms or engage in conduct that we determine, in our sole discretion, is harmful to our service or other users. You may also delete your account at any time through your account settings.

Upon termination, your websites will be taken offline and your data will be deleted in accordance with our data retention policies. We recommend exporting any content you wish to keep before closing your account.

In addition to voluntary account deletion, websites may be removed as a result of prolonged non-payment of subscription fees. In such cases, website data (excluding subdomains) is retained indefinitely to allow for restoration upon payment recovery. Active storefront orders will remain fulfillable regardless of website status.

9. Disclaimers & Limitations of Liability

Famous Title is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, secure, or error-free.

To the maximum extent permitted by law, Famous Title, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to loss of profits, data, or goodwill.

10. Indemnification

You agree to indemnify, defend, and hold harmless Famous Title, LLC, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the service, your violation of these terms, or your infringement of any third-party rights.

11. Governing Law & Disputes

These terms shall be governed by and construed in accordance with the laws of the State of Texas, USA, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of Famous Title shall be resolved exclusively in the state or federal courts located in Texas. Before initiating any legal action, you agree to first attempt to resolve the dispute informally by contacting us.

12. Changes to Terms

We may update these terms from time to time. We will notify you of any material changes by posting the new terms on our website and updating the "Last Updated" date above. For significant changes, we may also notify you by email. Your continued use of Famous Title after any changes constitutes your acceptance of the new terms.
